  All national groups are encouraging everyone to call, call, call! - Join MCDC, FAIR, Numbers USA, ALIPAC, Grassfire just to name a few of the dozens of organizations working together to save E-Verify - and our nation!

E-Verify is in true jeopardy right now and unless your Senators act now we are in jeopardy of losing the basic tool that helps companies determine worker's eligibility and weed out illegal aliens!

Our sources on Capitol Hill tell us that instead of responsibly reauthorizing E-Verify for the necessary full five-year term, Senators are going to pander to special interests and the Senate will only extend E-Verify for six months in a continuing resolution (CR).  A CR is a stop-gap spending measure meant to keep the government from shutting down after Congress adjourns since Congress failed to pass any spending bills this session.   

We understand that this agreement was meant to appease cheap labor business interests who want to kill E-Verify - especially in the states that have made it mandatory for their employers.  But, because they know that the American people would not stand for Congress to kill E-Verify right before an election, they have decided to punt this political football through the next election and into the next Congress where they feel they will be in a much better position to kill it or use it as a bargaining chip in a large amnesty measure.  

It is outrageous that in this turbulent economy, the Senate would bow to the cheap foreign interests and eliminate one of our most effective, efficient and accurate work-site enforcement tools designed to keep illegal aliens from displacing American workers.   

Please understand that when you call, Senate offices will try to tell you that E-Verify will be on the floor this week.  But what they are really talking about is their attempt to shove E-Verify into the CR with a six month only extension.  We need to let them know that this is unacceptable and that E-Verify must be brought to the floor as a stand-alone bill and reauthorized for a full five year term.  

Action Items:  

Call your individual Senators (202-224-3121) and Senate Majority Leader Harry Reid's office today (202-224-3542) and tell them to bring H.R. 6633, the House bill that authorizes E-Verify for five years, to the Senate floor.

I understand that illegal aliens are being exploited, and not only by their
coyotes, employers and now each other -however, no one should be
subjected to crime and extortion without protection and due process -let's

State police adopt new policy on undocumented farm workers

The director of the Vermont State Police says recent crimes against undocumented farm workers in Vermont have led to a new policy that will allow illegal immigrants to report criminal activity without fear of arrest or deportation. 

The move is being applauded by advocates for Mexican workers at Vermont dairy farms,
many of whom are in this country illegally. 


VPR's Steve Zind reports.

(Zind)  Earlier this month state police were called to investigate a series of assaults and robberies at three Grand Isle County Farms.  Among the victims were Mexican farm
workers.


Until now, state police have questioned immigrant workers about their legal status when responding to a reported crime - which, in the past, has led to the arrest and deportation of undocumented workers.

But Colonel James Baker, the director of the Vermont State Police, says this situation was a first.

(Baker) "It was a change in our position but it was the first time that we were confronted
with this situation where individuals because of their immigration status were being
targeted as victims."


(Zind)  Baker says from now on the policy of the state police will be not to inquire about a person's immigration status if they are a victim of, or a witness to a crime.

(Baker) "This is a public safety issue.  We have an obligation to protect everybody. 
It doesn't matter what their immigration status is.".

Ariz. immigrant and illegal immigrant numbers up sharply

Did we really expect to learn something different from the recent census reports? 1999-2001 was the height of the illegal invasion when a record low number of Border Patrol agents apprehended the highest number of illegal border crossers - almost 2 million a year leading up to the September 11, 2001 terrorist attacks.  
At least the census is good for something. Now just do some simple math -we allow approximately 2 million legal immigrants a year to enter our country - this includes folks from around the globe -not just Latin America. How does the number of illegal or legal immigrants from Latin America jump so high? The marches by illegal aliens demanding amnesty in the streets of America last year was a clear indication of the sheer magnitude of the illegal immigration problem in the U.S. Now we are beginning to cull hard numbers that will explicitly expose the wide spread invasion across our borders. And folks of Latin American descent wonder why they are feeling singled out?

he new figures today from the U.S. Census Bureau illustrate an explosion in the share of Arizona residents who came here from other countries.
That 991,584 estimate from the federal agency amounts to 15.6 percent of the state's population.
By comparison, only 12.8 percent of Arizonans were foreign-born when the official census was done in 2000. Ten years before that, the figure was 7.6 percent of the population.
While the Census Bureau pegs the number of foreign-born residents who are not U.S. citizens at slightly less than 700,000, it does not estimate how many in that group are here illegally.
But a separate report released by the U.S. Department of Homeland Security estimated Arizona's "unauthorized" population in January 2007 at 530,000, which would be about three out of every four non-citizen residents.
Homeland Security estimated a 60 percent jump from the 330,000 illegal immigrants the agency figured were in the state at the beginning of the decade.

Visconti Seeks RICO probe in Sanctuary Cities

Connecticut's 1st Congressional District Republican candidate Joseph Visconti Saturday called on
the US Attorney's office to launch an investigation into Hartford and New Haven's Sanctuary City
designations under the Racketeer Influenced and Corrupt Organizations Act (RICO).


Speaking on the steps of the New Haven City Hall where Mayor John DeStefano fired 35 city
employees Friday in a cost-cutting move, Visconti said, "Mayor DeStefano is refusing to protect the
health, safety and welfare of this city's legal residents."


"I have spoken to the US Attorney's office for New Haven and Hartford and will ask them to begin
an investigation under the Racketeer Influenced and Corrupt Organizations Act. We believe an
inquiry under this statute will result in indictments against the mayor of New Haven as well as
many other groups and individuals."


Visconti said the devastating impacts of illegal immigration on American society are self-evident
in New Haven. "Today, the equivalent of a platoon of New Haven city workers is enduring its first
day of unemployment. These people lost their jobs, and now face an uncertain future because the
mayor of this city decided it was more important to provide sanctuary for people who are here
 illegally, than to live up to his oath of office."


"The city of New Haven is tens of millions of dollars in debt due to the strain that illegal
 immigrants have placed on city services. Legal workers are losing their jobs, and the social
services budget can not possibly keep up with the influx of new claims resulting from the
Sanctuary City designation.


"And Hartford is next! This is criminal."

Visconti revealed that he has had preliminary discussions with representatives of the US
Attorney's  office and believes a RICO investigation is the preferred avenue to address the nation's
 illegal immigration problems.


"The mayor of New Haven has clearly been breaking federal immigration laws and celebrates his accomplishments today. He has conspired with like-minded individuals, groups and not for-profit
agencies. He is deliberately and intentionally inviting foreign criminals into our country and into
his city."


Visconti was one of several speakers who attended a Community Watchdog Project rally on the
steps of New Haven City Hall. The group has been fighting the Sanctuary City designation for
New Haven. The group estimates that New Haven has spent more than $71-million in taxpayer
money on education and social services for the estimated 15,000 illegal aliens living there since
DeStefano signed the Sanctuary City designation in December 2006.


Addressing the claim that the bulk of the illegals are workers doing jobs that Americans won't do
themselves, Visconti said, "As a General Contractor I see it every day skilled construction workers
 seeking jobs while illegal construction crews are brought in to perform carpentry, framing,
roofing, drywall, painting and many other jobs."


"These are not jobs Americans don't want. These are jobs my crews want; the kind of jobs I want."

Visconti said illegal immigration has become a critical issue in America because the Congress
refuses to address it honestly. This situation is a direct result of "the inaction and failures of
elected officials like Congressman John Larson and Rosa De Lauro, as well as Senator Chris Dodd."


"This City Slicker Mayor took it upon himself to break federal law for political purposes, because he
 knew full well his Congressmen and Senator would allow it and, we must assume, have condoned
 it. Our Senators and Congressmen talk endlessly, but accomplish nothing. It is up to us as citizens
 of the United States to use our own laws to our advantage."


"These federal office holders represent the Democratic leadership of the United States House of
Representatives and Senate, and the example they set is one of lawlessness and anarchy. We will
demand federal indictments under the RICO Statutes against those who are waging war against
the United States from within the United States. We will do what our elected representatives have
refused to do act responsibly and defend our way of life."

Paul Broun.  Broun is a solid conservative and has voted on the right side of the security and sovreign crisis.

Why Co-Sponsor H.R. 6783?

1.)     Preserve our patriotic expressions of loyalty, political values, and love of country
·    Reciting the Pledge of Allegiance or singing the National Anthem in languages other than English undermines the spirit of national unity.
·    Pledge Language is English Declaration and Government Endorsement Act of 2008 (H.R. 6783) bars federal funds for educational institutions that allow the Pledge of Allegiance and the National Anthem to be in languages other than English.
·    They were composed in English and were meant to be recited or sung exclusively in our national language.

2.)    American voters support the National Anthem and Pledge of Allegiance being sung or recited in English
·    According to 2006 Opinion Dynamics poll seventy-eight (78) percent of all voters agree that our National Anthem should be sung exclusively in English.
·    A Gallup poll in April 2006 found that 69% of American adults said it is only appropriate to sing the national anthem in English.  

3.)    In recent years, our unifying declarations have been eroded
·    Students in Arizona, New Mexico, and Wisconsin are being asked to recite the Pledge of Allegiance in Spanish and other languages in the name of diversity.
·    The Star Spangled Banner (Nuestro Himno) was composed in Spanish and broadcast in Spanish in 2006.  Lyrics were changed to condemn U.S. immigration laws--- "These kids have no parents, cause all of these mean laws ... let's not start a war with all these hard workers, they can't help where they were born."

Why the Pledge of Allegiance and Star Spangled Banner should be recited and sung in English alone

The Pledge of Allegiance and the Star Spangled Banner are public expressions of the loyalty, political values and love of country that unite Americans regardless of their differences. They have been recited or sung in our national language - English - since they were created. To recite or sing them in other languages directly undermines the spirit of national unity they are intended to foster.

Americans and people everywhere understand the symbolic importance of reciting the Pledge and singing the Star Spangled Banner in English. As Paul Reyes, mayor of El Cenizo, Texas - the only U.S. city to have adopted Spanish as its official language - said about the Star Spangled Banner, "I wouldn't go getting Mexico's flag and coloring it red, white, and blue."    

Yet, today students in states from Arizona to Wisconsin are being asked to recite the Pledge of Allegiance in Spanish and other languages in the name of "diversity." And the Star Spangled Banner has been composed in Spanish and broadcast in Spanish over the airwaves.  

Public policy should discourage such attempts at linguistic balkanization. As the late Barbara Jordan chair of the U.S. Commission on Immigration Reform, noted,
    "Cultural and religious diversity does not pose a threat to the national interest as     long as     public policies insure civic unity."

The American people overwhelming agree that public policy, and the taxes citizens pay, should be used to promote civic unity - not civic disunity, whether that means linguistic or any other kind. There are many areas in which the mindless promotion of "diversity" is harmful to our nation's wellbeing - and language is one of them. For example, a 2006 Gallup poll found that 7 out of 10 Americans (69 percent) agree that it is only appropriate to sing the National Anthem in English.  A Fox News/Opinion Dynamics poll the same year found that support was higher among likely voters, 8 out of 10 (78 percent).   

Public policy should discourage the linguistic separation and national division implicit in reciting the National Pledge of Allegiance or singing the Star Spangled Banner in any language other than English.

9th Circuit Court of Appeals upholds employer sanctions law

A federal appeals court has upheld Arizona's employer sanctions law, which penalizes businesses that knowingly hire illegal immigrants and requires them to verify the employment status of their workers.

Business and Hispanic groups challenged the law on the grounds that it oversteps the state's authority to regulate immigration, an argument that was rejected by the 9th Circuit Court of Appeals in a ruling released today.

The law imposes a civil penalty on businesses that knowingly hire illegal workers. Violating the law could cause a business's licenses to be suspended or revoked.

Although it upheld the law, the three-judge panel that heard the case left the door open for other challenges to the law, noting that no businesses have been prosecuted in the nearly nine months the law has been on the books and specifically pointing out that future challenges will not be controlled by the decision.

Lawyers for the state argued that while federal hiring law prevents states from imposing civil or criminal penalties against businesses for illegal hirings, the federal statute lets states take licensing actions against violators. The appellate court agreed with that argument.

Rep. Russell Pearce, who spearheaded the effort to enact a state law to punish businesses for hiring illegal immigrants, called the ruling a victory.

"You know what? Even the 9th Circuit gets things right every once in a while. What a great ruling," he said.

David Jones, president of the Arizona Contractors Association, one of the plaintiffs in the suit, said he wasn't surprised by the ruling, given the hostility the three-judge panel showed toward the arguments against the law when attorneys presented their cases before the San Francisco court in June.

"I didn't hear any comments from any of the judges on the panel that they favored any of our arguments on our case," he said.

Jones said he hadn't spoken with the co-plaintiffs or legal counsel yet, but he suspected the next move would be to seek en banc review, in which the entire 9th Circuit would examine the case and issue a ruling.

The court's rules allow for the entire court to hear a case only if the decision of the initial appeals panel conflicts with a Supreme Court decision or an earlier decision by the 9th Circuit.

Jones pointed to a decision by the 9th Circuit four days after attorneys gave oral arguments in the employer sanctions challenge that said an employer is not justified in firing an employee solely on the basis of receiving a letter from the Social Security Administration that the employee's Social Security number does not match the federal database.

That ruling, Jones said, seems to directly contradict the court's more recent ruling to upholding of the sanctions law, which requires Arizona employers to fire employees who are determined by the federal E-Verify employment eligibility database to be unauthorized to work.

"I'm not a lawyer, but it's confusing to me," he said.

Pearce said the cases have distinct differences, not the least of which is the E-Verify system, which does not rely solely on the Social Security database to determine eligibility. It also accesses data from the Department of Homeland Security.

Additionally, Pearce said, employees who receive a "tentative non-confirmation" from E-Verify are given eight days to challenge that finding and correct any errors in the federal databases. During that time, the employers are prohibited from taking any adverse action against the employee.

"They may try that," he said of an en banc review and argument based on the Aramark case, "but they know they'll lose there, too."
